Waiver and Release
URSA-SEC™ PRODUCT: WAIVER, RELEASE, AND ASSUMPTION OF RISK AGREEMENT
WARNING: Firearms are inherently dangerous. Ursa-Sec™ products are designed to enhance firearm functionality and may present risks if misused. Improper use, misuse, or lack of training with any firearm, including those equipped with Ursa-Sec™ products, can result in PROPERTY DAMAGE, SERIOUS PERSONAL INJURY, OR DEATH.
WARNING: ALWAYS PRIORITIZE SAFE FIREARM HANDLING. It is your responsibility to ensure safe handling of any firearm, including those equipped with Ursa-Sec™ products. You MUST be fully compliant with all applicable laws and regulations at all times while using this product. It is your responsibility to ensure that you are in compliance with all applicable laws at all times while using this product. Some jurisdictions may have restrictions on the use of certain firearm accessories.
ACKNOWLEDGMENT AND ASSUMPTION OF RISK: By purchasing and/or using any Ursa-Sec™ product, you acknowledge and voluntarily assume all risks associated with firearm ownership, use, and the potential for product misuse. This includes, but is not limited to, the risks of LIABILITY, INJURY, LOSS, DAMAGE, or DEATH resulting from improper use, misuse, installation, or abuse of the product. You understand that Ursa-Sec™ products may alter the function of a firearm, and you are solely responsible for understanding and safely operating any firearm equipped with our products.
WAIVER OF RIGHTS: By purchasing and/or using any Ursa-Sec™ product, you agree to waive and release any claims for damages, indemnity, or reimbursement against Ursa-Sec™ for any claims, fines, or damages imposed upon you related to the use of our products. You further agree to release Ursa-Sec™ (including its independent contractors, affiliated entities, parent companies, subsidiaries, present and former employees, owners, officers, members, managers, partners, contractors, insurers, shareholders, and directors) from any and all claims, actions, damages, liabilities, losses, costs, and expenses (including, without limitation, attorney fees) for death, injury, loss, or damage of property in any way arising out of the purchase, use, or misuse of Ursa-Sec™ products. You agree that Ursa-Sec™’s liability is limited to actual damages arising from gross negligence or willful misconduct of Ursa-Sec™. In no event shall Ursa-Sec™ be liable for any special, incidental, punitive, or consequential damages or other indirect damages.
INDEMNIFICATION: By purchasing or using any Ursa-Sec™ product, you agree to accept full responsibility for your use of the product and any consequences or fines imposed upon you by any governmental entity or third party. You agree to indemnify and hold harmless Ursa-Sec™ for any claims arising from your use of our products.
TRANSFER OF PRODUCT: If you sell, lease, gift, loan, or otherwise transfer any Ursa-Sec™ product to another individual (the recipient/assign), you agree, as a condition of acquiring this product, to ensure the recipient is fully aware of and agrees to the conditions set forth in this agreement. You agree not to transfer the product unless the recipient agrees in writing to the terms of this Waiver and Release. Failure to obtain such agreement renders you liable for any resulting claims or damages.
BINDING EFFECT: By purchasing or using any Ursa-Sec™ product, you agree that this waiver is binding upon you, your heirs, next of kin, personal representatives, beneficiaries, and assigns, and shall inure to the benefit of Ursa-Sec™ and its successors and assigns.
SEVERABILITY: If any provision of this Waiver and Release is declared invalid or unenforceable for any reason, the validity and enforceability of the remaining provisions will not be affected. The invalid or unenforceable provision will be deemed modified to the extent necessary to render it valid and enforceable.
GOVERNING LAW: This Waiver, Release, and Assumption of Risk shall be governed by and construed in accordance with the laws of Nevada, without regard to conflict of law principles. Any legal action or claim arising from this agreement shall be brought in [Your County/Jurisdiction].
DISPUTE RESOLUTION, BINDING ARBITRATION, AND CLASS ACTION WAIVER: To the extent permitted by applicable law, any controversy or claim arising out of or relating to the product, its design, functionality, materials, or this contract, or breach thereof, will be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. Under this arbitration provision, you give up the right to resolve any controversy or claim arising out of or relating to the product, including its design, functionality, materials, or this contract by a judge and/or a jury. Arbitration shall be under the [Your State/Jurisdiction] Rules and shall be conducted in [Your County/Jurisdiction]. You also agree not to participate as a class representative or class member in any class action litigation, any class arbitration, or any consolidation of individual arbitrations. The parties specifically agree with the binding nature of arbitration.
ELECTION: If you have any questions or do not agree with any of the terms in this agreement, DO NOT PURCHASE OR USE OUR PRODUCTS. By purchasing and continuing to use Ursa-Sec™ products, you indicate your voluntary agreement to all provisions of this waiver and release of liability.
WARNING: This product is intended for use by properly trained individuals. Improper understanding of how any firearm, including those equipped with Ursa-Sec™ products, operates may lead to unintentional or negligent discharge of the firearm and may lead to injury or death.
